• Managing and leading arbitrations of grievances filed by unionized employees challenging management’s policy, practices, and procedures, corrective action decisions, interpretations of, and failures to negotiate collective bargaining agreements in good faith, union avoidance campaigns, decertification proceedings, labor strikes, unfair labor practices proceedings before the NLRB, as well as good faith collective bargaining agreement negotiations with multiple international unions, including various unions under the AFL-CIO, such as SEIU, IBEW, USW, and ALPA, as well as several International and National Teamsters division locals, while providing counsel to clients in the airline, energy, oil & gas, healthcare, retail, education, technology, environmental, processing, architectural, manufacturing, distribution, and transportation industries, as well as serving as an arbitrator labor and contract disputes;
• Managing, as lead counsel, the defense of complex commercial and tort litigation actions, including, but not limited to, contract, shareholder, antitrust, M&A, reorganization, fiduciary, fraud, trademark, oil & gas, environmental, technology, PI, Qui Tam, disputes, and more, on behalf of clients in administrative and regulatory proceedings, arbitration, mediation, trial, DL litigation and on appeal, as well as serving as a mediator, labor arbitrator, and consulting and testifying expert witness in employment disputes;
• Investigating and defending federal and state employment-related disputes before the EEOC, FTC, DOL, OSHA, DOJ, DHS, FINRA, DFEH & DLSE, etc., as well as managing and leading the litigation of single plaintiff, multi-plaintiff, collective, and, class action matters, under Title VII, ADA, ADEA, FMLA, PDA, ERISA, HIPAA, FLSA, overtime, misclassification, wage and hour, worker’s compensation, whistleblower actions, theft of trade secrets and trademarks, non-competes, non-solicitation, and non-disclosures agreements, FEHA, PAGA, TCHRA, and various other state law employment-related disputes;
• Counseling and advising on stakeholders with respect to global privacy issues and mobility programs, handling global business, employment, expat, and family immigration matters, as well as strategies for defending traditional labor & employment-related disputes under international, federal, and state laws, developing forecasts, budgets, and decision-tree analysis, counseling and training stakeholders, human resources, and labor and employee relations personnel on leave management, including the interplay between FMLA and ADA, EEO, AA, USERRA, OFCCP and diversity training and compliance, tactically assessing, negating, mitigating, and/or managing risks, developing and implementing strategies to avoid and/or manage litigation, ensuring ethics and global compliance with applicable regulatory and statutory laws, as well as implementing impact analysis and best practices for human resources and corporations; and
• Drafting, negotiating, administering, analyzing, prosecuting, and/or defending the terms and conditions of contracts/agreements, such as founders, shareholders, directors, executive compensation, severance, collective bargaining, employment, independent contractor, intern, temporary worker, consulting, IT, IP, management, mergers and acquisitions, non-competes, non-disclosure, vendor, service, supply, buy-sell, invention, exclusivity, confidentiality, indemnity, mediation, arbitration, and release of liability agreements.
